Terms of Service

1. Acceptance of Terms
By accessing or using Aluga Facil App ("App," "Service," "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to any part of these Terms, you must not use the App. Your continued use of the App constitutes your acceptance of these Terms and any updates to them.
These Terms apply to all users, including both property owners/landlords and renters/tenants.
2. Description of Service
Aluga Facil App is a digital platform that enables users to:
- Create and manage user profiles and rental listings
- Upload, browse, and search rental property listings
- Share images, location-based information, and property details
- Communicate with other users regarding rental inquiries
- Access tools for property management and tenant communication
Aluga Facil App acts only as an intermediary platform. We do not own, manage, lease, guarantee, or control any listed properties. We are not a party to any rental agreements and bear no responsibility for transactions between users.
3. User Accounts & Registration
3.1 Account Creation
To use certain features of the App, you must create an account and provide accurate, complete, and current information. You agree to:
- Provide truthful information during registration
- Maintain and promptly update your account information
- Not create multiple accounts or use another person's account
- Not impersonate anyone else or misrepresent your identity
3.2 Account Responsibility
You are solely responsible for:
- Maintaining the confidentiality of your password
- All activities that occur under your account
- Notifying us immediately of any unauthorized use of your account
- Ensuring you log out after each session
We are not responsible for unauthorized access to your account due to your negligence or failure to secure your credentials.
3.3 Account Suspension & Termination
We reserve the right to suspend, deactivate, or terminate your account at any time, without notice, if:
- You violate these Terms
- You engage in fraudulent, illegal, or abusive activities
- Your account presents a risk to other users or the platform
- You fail to comply with our policies
4. Eligibility & Age Requirements
By using the App, you confirm that:
- You are at least 18 years old to independently create an account and enter into binding agreements
- If you are between 10-12 years old, you may use the App only with parental or legal guardian consent and supervision
- You are not a person restricted by economic sanctions (OFAC, EU, UN)
- You are legally able to enter into contracts in your jurisdiction
- You will comply with all local, regional, national, and international laws and regulations
5. User Content & Intellectual Property
5.1 Your Content Rights & Responsibilities
You retain ownership of any content you upload, including profiles, listings, photos, descriptions, and messages ("Your Content"). By uploading content, you grant Aluga Facil App a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content for platform operations.
You represent and warrant that:
- You own or have the legal right to use all content you upload
- Your content does not violate any third-party intellectual property rights
- Your content is accurate, truthful, and not misleading
- Your content does not contain illegal, harmful, abusive, or offensive material
- You have obtained necessary permissions from any individuals appearing in photos
5.2 Content Removal
We reserve the right to remove, hide, or restrict any content that:
- Is false, misleading, or fraudulent
- Contains offensive, abusive, discriminatory, or illegal material
- Violates these Terms or our community guidelines
- Infringes third-party rights
- Breaches privacy or safety of others
5.3 Platform Intellectual Property
The App, including its design, branding, logo, features, functionality, code, and all content provided by Aluga Facil App, are owned by or licensed to Aluga Facil App and are protected by copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, sell, license, or create derivative works from any part of the App without explicit written permission.
6. Prohibited Activities
You agree not to:
- Use the App for illegal purposes or to violate any laws
- Post false, misleading, or fraudulent property listings
- Harass, threaten, abuse, defame, or intimidate other users
- Upload harmful, malicious, or offensive content
- Attempt unauthorized access to the App or other users' accounts
- Interfere with the App's functionality or security
- Reverse engineer, hack, or attempt to compromise the App
- Collect personal data from other users without consent
- Engage in spam, phishing, or other deceptive practices
- Discriminate based on race, color, religion, gender, sexual orientation, or other protected characteristics
- Operate a competing rental platform using our data
- Bypass age restrictions or verification requirements
- Engage in transactions outside the platform to avoid our terms
7. Data Collection, Why & How It's Used
By using the App, you understand and consent to the following data practices:
7.1 What Data We Collect
We collect the following categories of data:
- Personal Information: Name, email address, phone number, address, other identifying information
- Location Data: Approximate location (when enabled)
- Photos & Videos: Property images and profile photos you upload
- App Activity: Interactions, search history, user-generated content
- App Performance Data: Crash logs, diagnostics, other app performance data
- Files & Documents: Verification documents, proof of identity
- Device IDs: Unique device identifiers for authentication and tracking
7.2 Why We Collect This Data
We collect data for the following purposes:
- App Functionality: To provide core features like listings, property search, messaging, and account management
- Analytics: To understand user behavior and improve app performance
- Developer Communications: To send updates, support responses, and service announcements
- Fraud Prevention & Security: To protect against abuse, verify identities (KYC/AML), and ensure platform safety
- Advertising or Marketing: To deliver personalized ads and promotional content (with your consent)
- Personalization: To customize your experience and provide relevant recommendations
- Account Management: To manage your account, process transactions, and provide support
7.3 How We Use Your Data
Your data is used in the following ways:
- Processing: Data is processed securely with encryption both in transit and at rest
- Analytics: Aggregated and anonymized for improving the app without identifying you
- Sharing: Shared with trusted service providers (payment processors, analytics services) under strict data protection agreements
- Marketing: Used for personalized recommendations only with your explicit consent
- Legal Compliance: Retained and used as required by law for tax, compliance, and dispute resolution
7.4 Location Data & Permissions

8. Transactions & User Responsibility
8.1 No Guarantee of Transactions
Aluga Facil App does not participate in, control, or guarantee any rental agreements or transactions between users. We are an intermediary platform only.
8.2 User Responsibilities
You are solely responsible for:
- Verifying property information and accuracy of listings
- Conducting due diligence before entering into agreements
- Negotiating terms with other users
- Completing transactions and managing rental agreements
- Resolving disputes with other users
- Complying with all local housing, tax, and rental laws
8.3 No Liability for User Interactions
We are not liable for disputes, fraud, non-payment, property damage, or any other issues arising from interactions between users or rental transactions.
8.4 Payment Processing
Any payments are processed by third-party payment providers. We are not responsible for payment processing errors, delays, or unauthorized charges. Refer to the payment provider's terms for dispute resolution.
9. Disclaimers & Warranties
9.1 "As Is" Disclaimer
The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:
- The App will meet your specific requirements
- The App will be uninterrupted, timely, or error-free
- Results obtained from the App will be accurate or reliable
- Any defects or errors will be corrected
9.2 Content Accuracy Disclaimer
We do not verify property information, listings, or user-provided content. We are not responsible for:
- Accuracy or completeness of property listings
- Availability of properties at the time of inquiry
- Quality, condition, or legal status of properties
- Truthfulness of user information or reviews
9.3 NO WARRANTIES
TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ALUGA FACIL APP SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Any damages resulting from user interactions or transactions
- Issues arising from rental agreements between users
- Technical failures, service interruptions, or data loss
Our total liability under these Terms shall not exceed the amount you paid to us in the past 12 months, or $100, whichever is less.
11. Indemnification
You agree to indemnify and hold harmless Aluga Facil App, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any applicable laws
- Your content or listings
- Your interactions with other users
- Infringement of third-party rights
12. Termination
12.1 Termination by You
You may terminate your account at any time by contacting support or through your account settings. Upon termination, we will cease providing services but may retain certain data as required by law.
12.2 Termination by Us
We may terminate or suspend your account immediately without notice if you violate these Terms, engage in illegal activities, or pose a risk to other users. Upon termination, your access to the App will be revoked.
12.3 Effect of Termination
Termination does not relieve you of obligations incurred prior to termination. Sections regarding indemnification, limitation of liability, disclaimers, and intellectual property shall survive termination.
13. Dispute Resolution & Governing Law
13.1 Governing Law
These Terms are governed by and construed in accordance with the laws of Mozambique, without regard to its conflict of law principles.
13.2 Dispute Resolution
Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in Mozambique, except for intellectual property disputes which may be brought in court.
13.3 No Class Actions
You agree that any dispute resolution proceeding shall be conducted on an individual basis, not as a class action, class arbitration, or collective claim.
14. Changes to Terms
We may update or modify these Terms at any time. We will notify you of material changes via email or prominent notice in the App. Your continued use of the App 30 days after such notice constitutes acceptance of the updated Terms.
If you do not agree to the updated Terms, you must stop using the App.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, or if impossible, severed. The remaining provisions shall remain in full force and effect.
